Prescriptions 2009-2102

The Bermuda Sailing Association (BSA) prescribes the following with reference to the Racing Rules of Sailing, 2009-2012:

PART 3

Rule 34

Change rule 34 title to: MARK MISSING; RACE COMMITTEE ABSENT

After rule 34 add

BSA prescribes that, if a finishing mark is missing but another one remains in place, a boat shall finish as close to the remaining mark as practicable on a line extending from its required side at a 90 degree angle to the last leg. If a boat finishes when the race committee is absent, to be scored as finishing she shall note her finishing time and her finishing position in relation to any nearby boats and report them to the race committee as soon as reasonably possible.

Rule 40

Change rule 40 title to: PERSONAL FLOTATION DEVICES; LIFE-SAVING EQUIPMENT

After rule 40 add

BSA prescribes that every boat shall carry life-saving equipment conforming to government regulations that apply in the racing area.

Rule 48

After rule 48 add

BSA prescribes that the use of additional special purpose lights such as masthead, spreader and jib luff lights shall not constitute a breach of this rule.

Rule 55

Add rule 55

55 FLAGS

BSA prescribes that a boat shall not display flags except for signaling. A boat shall not be penalized for breaking this rule without prior warning and opportunity to make correction.

Rule 61.4

61.4 Fees for Protests and Requests for Redress

BSA prescribes that no fees shall be charged for protests or requests for redress.

Rule 64.3 (b)

After rule 64.3(b) add

BSA prescribes that the authority responsible for interpreting the rules of a handicap or rating system is the organization that issued the handicap or the rating certificate involved. 

Rule 68

After rule 48 add

BSA prescribes that:

1.         Any claim for damages arising from an incident while a boat is bound by the Racing Rules of Sailing shall be subject to the jurisdiction of the courts and not considered by a protest committee.

2.         A boat that takes a penalty or retires does not thereby admit liability for damages or that she has broken a rule.

PART 6

Rule 76.1

After rule 76.1 add

BSA prescribes that an organizing authority or race committee shall not reject or cancel the entry of a boat or exclude a competitor eligible under the notice of race and sailing instructions for an arbitrary or capricious reason or for reason of race, color, religion, national origin, gender, sexual orientation, or age.

76.3 BSA prescribes that a boat whose entry is rejected or cancelled or a competitor who is excluded from a race or series shall be, upon written request, entitled to a hearing conducted by the protest committee under rules 63.2, 63.3, 63.4 and 63.6.

Rule 78.4

78.4 BSA prescribes that:

The race committee may inspect or measure any boat, as defined in the Equipment Rules of Sailing C.2.1, or personal equipment, as defined in the Equipment Rules of Sailing C.1.3, at any time.

Rule 86.3

After rule 86.3 add

BSA prescribes that proposed rules may be tested, but only in local races.

However, proposed rules may also be tested at other events if, for each event, the organizing authority first obtains written permission from BSA and the proposed rules are included in the notice of race and sailing instructions.

88.2

BSA prescribes that:

Notices of race and sailing instructions shall not change a prescription of the BSA, other than the prescriptions to rules, 34, 78 and Appendix Q. For an international event the prescription to rule 40 may be deleted.

APPENDIX Q – SOUND-SIGNAL STARTING SYSTEM

This appendix is a BSA prescription.

BSA prescribes that, when the sailing instructions so indicate, the Sound-Signal Starting System described below shall be used. This system is recommended primarily for small-boat racing and makes it unnecessary for competitors to use stopwatches. Supplemental visual course and recall signals are also recommended when practicable.

Q1 Course and postponement signals may be made orally.

Q2 Audible signals shall govern, even when supplemental visual signals are also used.

Q3 The starting sequence shall consist of the following sound signals made at the indicated times:

Q4 Signals shall be timed from their commencement.

Q5 A series of short signals may be made before the sequence begins in order to attract attention.

Q6 Individual recalls shall be signaled by the hail of the sail number (or some other clearly distinguishing feature) of each recalled boat. Flag X need not be displayed.

Q7 Failure of a competitor to hear an adequate course, postponement, starting sequence or recall signal shall not be grounds for redress.

 

The Bermuda Sailing Association (BSA) prescribes the following with reference to the ISAF Regulations:

REGULATION 20, ADVERTISING CODE

Regulation 20.4.2

BSA prescribes that:

When the display of Category C advertising is permitted, Bermuda competitors are licensed to display the advertising, and no individual application to the BSA is needed.

Regulation 20.4.3

BSA prescribes that:

An organizing authority wishing to restrict advertising in an event to Category A shall apply to the BSA at least 15 days before publishing the notice of race, confirming:

1. for a club event, that the event:

i. is sponsored, organized or held by a club which has sailing as one of its activities, and

ii. does not form part of a wider series for which Category C boats are eligible, and

iii. is not a qualifier for another event for which Category C boats are eligible.

2. for an invitational event, that the event is not a qualifier for an International Class event.

The BSA will normally grant approval if such an application is received.

The restriction to Category A and the BSA statement of approval shall be included in the notice of race. Any restriction to Category A shall apply to boats while they are racing. When the organizing authority wishes the restriction to apply at other times during an event, it shall specify such times, and the reasons, in its initial application. If this extra restriction is approved by the BSA, it and the BSA statement of approval shall be included in the notice of race.

Regulation 20.5

BSA prescribes that:

1. A controller of a handicap system or rating rule may request the BSA:

i. to decide that races held under that system or rule are Category C, or are Category C with restrictions stated in the request.

ii. to sub-divide the system or rule into two or more sub-systems or sub-rules with different Categories. Race results may later be combined.

The BSA will normally agree to such a request.

2. When a handicap system is controlled by the organizing authority for the races to be sailed under that system and when permission as required has been received from the BSA for Category C advertising to be displayed, the notice of race shall so state, and shall state any approved restriction.

3. Regulation 20.4.3, and the prescription thereto, apply to clubs organising handicap racing.

Regulation 20.7

BSA prescribes that:

Boats displaying Category C advertising are not required to pay a fee to the BSA.

REGULATION 21, ANTI-DOPING CODE 

Banned Substances and Methods

The national authority procedural rules required by ISAF regulation 21.14 to implement the World Anti-Doping Code through ISAF Regulation 21 are the Bermuda Council for Drug Free Sports, the National Anti-Doping Organisation, procedures.
